Official Hangry Sweepstakes Rules

1. Eligibility

The Hangry Social Media Sweepstakes (hereinafter the “Sweepstakes”) is only open to legal residents of 49 United States and the District of Columbia who are at least 18 years old at the time of entry. Residents of the Rhode Island and Puerto Rico are prohibited from entering this Sweepstakes. Employees of Sponsor and other companies associated with the promotion of the Sweepstakes, and their respective parents, subsidiaries, affiliates and advertising and promotion agencies as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. The Sweepstakes is subject to federal, state, and local laws and regulations. Void where prohibited. The winner agrees that the Sponsor, its affiliates and its agents and employees shall not be liable for injury, loss or damage of any kind resulting from participating in this promotion or from the acceptance or use of any prize awarded. Sponsor reserves the right to verify eligibility qualifications of any winner.

2. Sponsor

The Sweepstakes is sponsored by Ostara LLC (“Sponsor”), located at 7750 Clayton Rd. Suite W307, St. Louis, Missouri, 63117, www.ostara.com.

3. Agreement to Official Rules

Participation in the Sweepstakes constitutes the entrant’s full and unconditional agreement to and acceptance of these Official Sweepstakes Rules (“Official Rules”) and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon being compliant with these Official Rules and fulfilling all other requirements set forth herein.

4. Sweepstakes Period

The Sweepstakes begins on September 1, 2023, at 5:00 a.m. E.T. and ends on September 30, 2023, at 11:59 p.m. E.T. (the “Sweepstakes Period”). Entries that are submitted before or after the Sweepstakes Period will be disqualified. Submissions will be accepted for the duration of the Sweepstakes at the online site, as provided below.

5. How to Enter

Online: This method of entry will be available by visiting Ostara’s social media and following the directions or by following the instructions received through emails, Sponsor’s website, Sponsor’s Facebook page and Sponsor’s Twitter/X App posts.

For entry for a chance to win, an entrant will complete and submit a form where the entrant is asked to provide certain information, including the entrant’s name and email address. Each entrant who enters electronically will receive a unique URL that can be shared to promote the Sweepstakes to the entrants’ friends and family. Limit one entry per person, per customer, per email address and per household for the duration of the Sweepstakes Period. Entries received from any person, email address or household in excess of the stated limitation will be void. All entries become the property of Sponsor and will not be acknowledged or returned.

6. Conditions of Entry

Eligible entrants must enter via one of the online methods as described. To be eligible for entry, the entrant must follow the Sponsor’s Crystal Green^® account on the platform of entry. Incomplete entries are void. Any entry by a resident of Rhode Island or Puerto Rico is void. By entering, entrants acknowledge compliance with these Official Rules, including all eligibility requirements. The Sponsor is not responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any website or online service, or any other error or malfunction, or late, lost, postage due, illegible or misdirected entries. Entry materials that have been tampered with or altered are void. No copies, facsimiles or reproductions of official entry forms will be accepted. You are solely responsible at your sole cost and expense for creating backup copies and replacing any content you post or submit through Sponsor’s Facebook page. You agree that under no circumstances will Sponsor be liable in any way for any loss or damage to any content you post, email or otherwise make available to Sponsor.

7. Prize Drawings

On or before October 13, 2023 (but in no event before September 30, 2023), the Sponsor will select the potential winner in a random drawing from among all eligible entries received by 11:59 p.m. E.T. on September 30, 2023. The Grand Prize winner and winners of the Runner-Up Prizes will be selected in a random drawing from among all eligible entries received. The odds of being selected as the Grand Prize winner or the winner of any Runner-Up Prize depends on the number of entries received. The Sponsor will attempt to notify the potential Grand Prize winner via email during the week of October 13, 2023. If the potential Grand Prize winner cannot be contacted within one day after the date of the first attempt to contact winner, the Sponsor may select an alternate potential Grand Prize winner in winner’s place at random from the remaining non-winning, eligible entries.

8. Grand Prize Winner Notification & Prize Delivery

The potential Grand Prize winner will be notified by email. The potential winner will be required to complete, sign and submit a Declaration of Compliance. The Declaration of Compliance will be emailed to the potential winner after contact within five business days after the time of notice or attempted notice is sent, in order to claim winner’s prize by either (a) email to info@ostara.com. If a potential winner cannot be contacted, or fails to submit the Declaration of Compliance within the required time period, or the prize is returned as undeliverable, the potential winner forfeits the prize. If the potential winner is at least 18 but still considered a minor in winner’s jurisdiction of residence, Sponsor reserves the right to award the prize in the name of winner’s parent or legal guardian, who will be required to sign the Declaration of Compliance on the potential winner’s behalf and fulfill any other requirements imposed on winner set forth herein. Potential winners must continue to comply with all terms and conditions of these Official Sweepstakes Rules, and winning is contingent upon fulfilling all requirements. In the event that a potential winner is disqualified for any reason in Sponsor’s sole discretion, Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. Only three alternate drawings will be held, after which the prize will remain un-awarded. The Grand Prize will be awarded after the conclusion of the Sweepstakes and after the receipt of the potential winner’s Declaration of Compliance and be delivered via either United States Postal Service ground mail, UPS or FedEx, as determined by Sponsor.

9. Runner-Up Winners Notification

The Sponsor will attempt to notify the potential winners of the Runner-Up Prizes via email (through the email and at the phone number submitted by the potential winner to enter the Sweepstakes) during the week of October 13, 2023. If the potential winners cannot be contacted within one day after the date of the first attempt to contact winner, the Sponsor may select an alternate potential winner in winner’s place from the remaining non-winning, eligible entries. The potential winners will be required to complete, sign and submit a Declaration of Compliance within five business days after the time of notice or attempted notice is sent, in order to claim winners’ prize by either (a) email to info@ostara.com. If a potential winner cannot be contacted, or fails to submit the Declaration of Compliance within the required time period, or the prize is returned as undeliverable, the potential winner forfeits the prize. If a potential winner is at least 18 but still considered a minor in winner’s jurisdiction of residence, Sponsor reserves the right to award the prize in the name of winner’s parent or legal guardian, who will be required to sign the Declaration of Compliance on the potential winner’s behalf and fulfill any other requirements imposed on wRunninner set forth herein. The Runner-Up Prizes will be awarded after the conclusion of the Sweepstakes Period within three weeks after the Sponsor’s receipt of the potential winner’s Declaration of Compliance, via either United States Postal Service ground mail, UPS or FedEx, in each case as determined by Sponsor.

10. Potential Prizes

One of the following prizes will be awarded to each of the potential winners in the Sponsor’s discretion:

The “Runner-Up Prizes”:

Crystal Green^®-branded lunch pail.
Crystal Green^®-branded Hangry stickers.
Crystal Green^®-branded t-shirt.

The “Grand Prize”:

Bison 50 Hard Cooler branded with Crystal Green^® sticker and containing other Crystal Green^®-branded items and snacks, for a total approximate retail value of $500.00.

Any taxes on prizes won will be the sole responsibility of the winner. No substitution or transfer of prizes is permitted unless an item is not available or delivery is not possible (for any reason or no reason) to the address of the potential winner. Sponsor shall be entitled to substitute the item with a comparable replacement product with the same or better features. Sponsor has no affiliation with the companies that have prizes included in the prize bundle. The platforms on which this Sweepstakes is being conducted, together with their parent companies, including without limitation Meta Platforms, Inc. and X Corp., have no affiliation with Sponsor or this Sweepstakes.

11. General Conditions

In the event that the operation, security or administration of the Sweepstakes is impaired in any way for any reason, including, but not limited to, fraud, virus, bug, worm, unauthorized human intervention or other technical problem, or in the event the Sweepstakes is unable to run as planned for any other reason, as determined by Sponsor in its sole discretion, the Sponsor may, in its sole discretion, either (a) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules or (b) terminate the Sweepstakes and, in the event of termination, award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to damage the website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages (including attorneys’ fees and costs) and any other remedies from any such person to the fullest extent. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision.

12. Release and Limitations of Liability

By participating in the Sweepstakes, entrants agree to release and hold harmless the Sponsor, and each of its respective parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the Sweepstakes, and each of their respective officers, directors, employees, sweepstakes judges or entrant counters, shareholders, representatives, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of the prize, including, but not limited to: (a) any technical errors associated with the Sweepstakes, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the Sweepstakes; (c) mechanical, network, electronic, computer, human, printing or typographical errors; (d) application downloads; (e) any other errors or problems in connection with the Sweepstakes, including, without limitation, errors that may occur in the administration of the Sweepstakes, the announcement of the winner, the incorrect downloading of the application, the processing of entries application downloads or in any Sweepstakes-related materials; or (f) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants participation in the Sweepstakes or acceptance, receipt or misuse of the prize. Entrant further agrees that in any cause of action, the Released Parties liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the entrant be entitled to receive attorneys’ fees or other related costs. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct or indirect damages.

13. Disputes

Except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Missouri. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrants rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of Missouri, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than Missouri.

14. Use of Entrant Information by Sponsor

By entry into this Sweepstakes, each entrant consents to the use of the entrant’s name, identity, photograph, and any photo, video, or text post or submission (if applicable) for promotional purposes, including online announcements, without additional compensation, except where prohibited by law, even if such entrant’s submission is not selected as a winning submission for this Sweepstakes. If the Sweepstakes is terminated prior to the end of the stated entry period, notice will be posted on Ostara’s social media. Any attempt to deliberately damage the content or operation of this Sweepstakes is unlawful and subject to legal action by Sponsor and/or its agents. To request the name of the winner send a self-addressed stamped envelope to Sponsor at 7750 Clayton Rd. Suite W307, St. Louis, Missouri, 63117. Winner list requests will only be accepted after the promotion end date (stated above). Requests received after one month past notification date will not be honored.

15. Privacy Notice

Entrants should read the “Privacy Policy” for Sponsor, located at https://ostara.com/privacy-policy/. By entering this Sweepstakes, entrants may receive marketing materials, communications and other materials from the Sponsor and affiliated or other companies whose products and services the Sponsors feel might interest entrants at a future date. An entrant not interested in receiving this material, should send an email to info@ostara.com to notify Sponsor of entrant’s desire not to receive such materials.
